The DigiTindahan is operated and maintained by Great Deals E-Commerce Corporation (“GDEC”), the official e-commerce distributor of Nestlé Philippines, Inc. (“Nestlé”).

The DigiTindahan is an online platform within the Barangay Nestlé website, which makes it accessible for you to purchase Nestlé products, by connecting you with GDEC, who will in turn receive, process, complete and fulfill your purchase.

We are committed to maintaining trust with users and customers of the DigiTindahan. The terms below govern your use of the DigiTindahan website.

1. Acceptable use

Please feel free to explore the DigiTindahan website and, where available, contribute material to it, such as questions, posts, ratings and reviews and multimedia content (e.g. pictures, videos).

However, your use of this website and materials posted to it should not be illegal or offensive in any way. You should be mindful not to:

(a) breach another person’s right to privacy;
(b) infringe any intellectual property rights;
(c) make statements that are defamatory (including towards Nestlé and GDEC), relate to pornography, are of a racist or xenophobic nature, promote hatred or incite to violence or disorder;

Please note that we may remove any content from this website that we believe maybe illegal or offensive. 3.1. Content provided by Nestlé

All intellectual property rights, including copyright and trademarks, in materials published by or on behalf of Nestlé on the DigiTindahan website (e.g. text and images) are owned by Nestlé or its licensors.

3.2. Content provided by You

3.3 Rules governing consumer ratings and review service

In addition to these terms the following additional rules apply for ratings and review services, where applicable. In order to submit any content to any rating and review service available on this website (such as text, photo, video, likeness or other material or information), you must be 18 years of age or older, or have received the consent of the person/s exercising parental authority. If you have received prior payment or promise of payment in return for your proposed submission; or if you have received an incentive such as free product, discounts, gifts, sweepstakes entries you will disclose it in your submission. If you are a Nestlé or GDEC employee or work for a company or agency hired by Nestlé, you have to disclose that relationship.

All content that you submit is accurate and is based upon your actual experience with the product being reviewed. It shall not include any information that references other websites, addresses, email addresses, contact information or phone numbers. You are responsible for the content of your submission, not Nestlé or its official distributor operating and maintaining the DigiTindahan website.

While we use all reasonable efforts to ensure the accuracy of materials on our website and to avoid disruptions, we are not responsible for inaccurate information, disruptions, discontinuance or other events which may cause you damage, either direct (e.g. computer failure) or indirect (e.g. loss of profit). 5. General Conditions of Sale

Applicability of General Conditions of Sale

a. Each order placed in the DigiTindahan shall be governed by the Terms and Conditions of this website.

Orders

a. There is no minimum order quantity of products in the DigiTindahan. However, product orders shall be within the limits of available stocks.
b. To the extent permitted by law, the DigiTindahan is entitled to, at any time, without providing reasons and with no liability to you or any third parties, verify an order, and to refuse, cancel or terminate an order for any reasonable ground. Our refusal or cancellation of an online order may include, but shall not be limited to the following reasons:
  • Product is totally or partially unavailable after the order is made;
  • Failure of payment and/or non-payment within period provided;
  • Fraudulent transactions;
  • Incomplete or invalid delivery address
  • Paid but unfulfilled orders

c. Please retain a copy of your transaction that will be sent to you via email or SMS

Delivery

a. The DigiTindahan exerts all efforts to ensure timely delivery to its customers. The following delivery periods shall apply, after the order is confirmed and completely processed:
  • if delivery is within Metro Manila – 1-3 days
  • if delivery is outside Metro Manila – 5-10 days
When counting estimated delivery periods, Saturdays, Sundays and holidays shall be excluded.
b. Delivery charges shall apply unless otherwise specified.

Order Cancellations

a. You may cancel your order at any given time before its confirmation. Once confirmed, cancellations shall no longer be entertained and you can no longer change the products in your original order. To cancel, you may notify us by contacting us through any of the following means:

Refund and Returns Policy

a. Refund or product returns shall only be entertained if filed within 7 days from the customer’s receipt of the products.
b. Only the following reasons may be validly considered for purposes of refund/returns:
  • delivery of wrong product
  • delivered product is damaged
  • incomplete delivery of products

Pricing and Payment

a. The prices invoiced for products ordered are those in effect on the date of order and shall be inclusive of VAT.
b. The following modes of payment shall be recognized in the DigiTindahan: credit card/debit card, e-wallets, OTC, online banking Or COD.

Password and Confidentiality

If we know, notice or have reason to believe that your registration credentials have been compromised or used by another person, the DigiTindahan reserves the right to suspend your account.
